NearBetter Affiliate (Promoter) Terms & Conditions

These Affiliate (Promoter) Terms & Conditions (“Agreement”) govern participation in the NearBetter Affiliate Program operated by NearBetter / Unibare India (“Company”, “We”, “Us”). By registering as an Affiliate/Promoter, you agree to comply with the terms below.

1. Definitions

  • Affiliate / Promoter: An individual or group approved by NearBetter to promote products and generate sales through referral links, QR codes, or offline methods.
  • Customer: Any end user purchasing NearBetter products.
  • Commission: The incentive payable to Affiliates on eligible sales.
  • Affiliate Dashboard: The online portal provided to track referrals, commissions, and payouts.

2. Eligibility & Registration

  • Applicant must be 18 years or above.
  • Registration does not guarantee approval. NearBetter reserves the right to accept or reject any application.
  • Affiliates must provide accurate personal, contact, and payment details.
  • One person is allowed only one affiliate account.

3. Affiliate Status & Approval

  • All new affiliate accounts are created in Pending status.
  • Activation is subject to internal verification by NearBetter.
  • NearBetter may suspend or terminate any account without prior notice if policy violations are found.

4. Commission Structure

  • Commission rates are defined by NearBetter and may vary by product, category, or campaign.
  • Current standard commission (indicative): up to 20% on eligible product value.
  • Shipping charges and taxes are excluded from commission calculation.
  • Affiliates are not eligible to earn commission on their own purchases.

5. Tracking & Attribution

  • Commissions are tracked using cookies and/or referral identifiers.
  • Cookie validity is 30 days from the last referral click.
  • Last Affiliate attribution model is followed (last valid referrer gets the commission).
  • NearBetter is not responsible for lost commissions due to cleared cookies, device change, or technical issues beyond reasonable control.

6. Refunds, Cancellations & Reversals

  • If a customer order is cancelled, returned, or refunded, the associated commission will be rejected or reversed.
  • A refund grace period applies before commissions become eligible for payout.
  • NearBetter’s decision regarding refunds and commission reversals is final.

7. Payouts

  • Minimum payout threshold: ₹500 (Indian Rupees).
  • Payouts are processed only for Approved and Unpaid commissions.
  • Affiliates must provide a valid payment email or bank/payment details.
  • Payout timelines may vary based on internal processing cycles.

8. Permitted Promotion Methods

Affiliates may promote NearBetter through:

  • Door-to-door promotion
  • Word-of-mouth referrals
  • Social media (WhatsApp, Instagram, Facebook, etc.)
  • Personal websites or blogs

All promotions must be honest, respectful, and transparent.

9. Prohibited Activities (STRICTLY NOT ALLOWED)

  • False claims, misleading information, or fake offers
  • Spamming (SMS, WhatsApp, email, or social media)
  • Misrepresentation as an employee or official representative of NearBetter
  • Promotion of NearBetter on illegal, adult, or unethical platforms
  • Self-referrals or manipulation of tracking systems

Violation may result in immediate termination and forfeiture of commissions.

10. Brand Usage Guidelines

  • Affiliates may use approved NearBetter brand assets (logo, banners) only.
  • Modification of brand identity without written approval is prohibited.
  • NearBetter reserves all rights to its trademarks and branding.

11. Independent Relationship

  • Affiliates act as independent promoters, not employees, agents, or partners.
  • This agreement does not create any partnership, franchise, or employment relationship.

12. Limitation of Liability

  • NearBetter is not liable for indirect, incidental, or consequential damages.
  • Total liability, if any, shall not exceed the commission paid to the affiliate in the previous month.

13. Modification of Terms

  • NearBetter reserves the right to update or modify these Terms & Conditions at any time.
  • Continued participation after changes constitutes acceptance of the revised terms.

14. Termination

  • Either party may terminate this agreement at any time.
  • Upon termination, access to the affiliate dashboard will be revoked.
  • Unpaid commissions earned through violations will not be paid.

15. Governing Law & Jurisdiction

  • This Agreement shall be governed by the laws of India.
  • Any disputes shall be subject to the jurisdiction of courts in Kerala, India.
